Terms & Conditions

These Terms & Conditions govern purchases from the Mister Jewels website and form part of the agreement between the customer and Guangzhou Mister Jewels Jewelry Co., Ltd. (广州米修特饰品有限公司), referred to below as “Mister Jewels,” “we,” “us,” or “our.” Please read them before placing an order.

Nothing in these Terms excludes or limits any right that cannot lawfully be excluded under applicable consumer-protection or other mandatory laws.

1. Eligibility

This website is intended for customers aged 18 or older. A person under 18 may place an order only with the knowledge and consent of a parent or legal guardian. The guardian is responsible for reviewing and accepting these Terms and for supervising the purchase.

2. Products & Specifications

We make reasonable efforts to present product descriptions, dimensions, colors, stones, materials, plating, photographs, and prices accurately. Screen settings, lighting, hand finishing, stone setting, plating, and material batches may cause reasonable visual or dimensional variation.

Unless a product page states otherwise, pendant measurements do not include the bail. Normal dimensional tolerance is approximately 0.5–1.5 mm, depending on the design and production process. Please review the Size Guide or contact us before ordering if an exact measurement is important.

3. Prices & Quotation Validity

Website prices and quotations may change when the market price of gold, silver, or another raw material changes. A price change does not normally affect an order already validly concluded, except where there is an obvious pricing error or another lawful basis for correction or cancellation.

  • Brass and cubic-zirconia quotations: valid for 7 calendar days unless the quotation states otherwise.
  • Silver and solid-gold quotations: valid for 3 calendar days unless the quotation states otherwise.

Prices are displayed in the currency shown at checkout. Import duties, taxes, customs charges, and destination-country fees are the customer’s responsibility unless DDP service or another arrangement is confirmed in writing before shipment. See Shipping & Delivery.

4. Orders & Contract Formation

An order is submitted when the customer completes the checkout process and payment. We will send an order-confirmation email recording the products, prices, shipping information, and other order details.

The electronic contract is formed at the time required by applicable mandatory law. Where the product or service information published on the website constitutes an offer, the contract may be formed when the customer successfully submits the order. Nothing in these Terms is intended to postpone contract formation after payment in a manner prohibited by applicable law.

Please review all product, personalization, size, shipping-address, and contact details before submitting the order. Contact us immediately if an input error is discovered.

5. Stock, Listing & Pricing Errors

If a product is unavailable, incorrectly described, incorrectly priced, or affected by a stock or system error, we may correct the information, propose an order modification, or cancel the affected order to the extent permitted by law. If an order is cancelled for one of these reasons, the amount paid for the cancelled item will be refunded in full to the original payment method.

6. Payment, Fraud Screening & Chargebacks

Orders may be subject to payment verification, identity checks, address checks, and reasonable fraud screening. We reserve the right to hold, request additional verification for, or cancel an order that we reasonably suspect to be fraudulent, unauthorized, or otherwise unlawful.

If a chargeback or card dispute is opened, we may submit order records, payment information, communications, production records, photographs, shipment tracking, delivery evidence, and other relevant transaction evidence to the payment provider. For a fraudulent, abusive, or unfounded dispute, the customer may be responsible for resulting fees and provable losses to the extent permitted by applicable law. This clause does not restrict a customer’s right to raise a genuine payment dispute.

7. Custom Jewelry & Customer Artwork

The customer retains copyright in original artwork supplied by the customer. By providing artwork, logos, photographs, trademarks, names, or other materials, the customer confirms that they own the necessary rights or have permission to use them and that the requested production will not infringe a third party’s intellectual-property, privacy, or other rights.

The customer is responsible for claims or losses arising from materials supplied without the necessary rights, to the extent permitted by law. We may refuse or cancel a project that appears unlawful, infringing, deceptive, or unsuitable for production.

An order may be cancelled before production begins. A custom order may also be cancelled after CAD approval, but the completed CAD design fee is non-refundable; the sample fee will be refunded in accordance with the applicable order record. See Returns & Exchanges.

8. Mister Jewels Intellectual Property

All original designs, CAD files, photographs, graphics, text, branding, logos, product concepts, and other materials created by Mister Jewels are owned by Guangzhou Mister Jewels Jewelry Co., Ltd. or used under authorization. They may not be copied, reproduced, modified, manufactured, distributed, or commercially used without prior written permission.

9. Resale, Private Label & Wholesale

Customers may resell genuine ready-stock products they lawfully purchase. Private-label, OEM, and custom manufacturing are supported when confirmed with us before production.

Retail purchases are governed by these website Terms. Wholesale orders are governed by the Proforma Invoice (PI), quotation, specifications, approved CAD, payment terms, and other written terms confirmed by both parties. If an agreed wholesale PI conflicts with these website Terms, the PI and the specific written wholesale agreement take priority for that wholesale order.

10. Shipping, Delivery & Customs

Shipping prices, delivery estimates, carriers, customs responsibilities, DDP availability, address changes, and procedures for lost or delivered-but-not-received packages are described in our Shipping & Delivery Policy. Delivery estimates are not guaranteed arrival dates.

11. Returns, Warranty & Jewelry Care

Returns, quality-issue claims, cancellations, refunds, warranty periods, repair shipping, and replacement rules are governed by our Returns & Exchanges Policy and Warranty Policy. Customers should follow the Jewelry Care Guide to help preserve plating, metals, stones, and settings.

12. Limitation of Liability

To the fullest extent permitted by law, Mister Jewels is not liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable when the contract was formed. Our aggregate liability for a claim relating to a product will not exceed the amount paid for that product, except where a greater liability is required by mandatory law.

Nothing in these Terms limits liability for fraud, deliberate misconduct, personal injury caused by legally established fault, or another liability that cannot lawfully be limited or excluded.

13. Force Majeure

We are not responsible for delay or failure caused by events reasonably beyond our control, including natural disasters, severe weather, epidemic restrictions, war, civil disturbance, government action, customs interruption, carrier disruption, power or network failure, labor disruption, or material-supply interruption. We will take reasonable steps to reduce the effect and communicate material delays.

14. Governing Law & Dispute Resolution

These Terms and related transactions are governed by the laws of the People’s Republic of China, without prejudice to any mandatory consumer protections that apply and cannot lawfully be excluded.

The parties should first attempt to resolve a dispute through good-faith communication. If the dispute cannot be resolved, it will be submitted to the competent courts in Panyu District, Guangzhou, China, except where mandatory law requires a different forum.

15. Changes to These Terms

We may update these Terms when our products, services, legal obligations, or business processes change. The version published when an order is placed will normally apply to that order, unless a change is required by law or agreed by the parties.
